Trademarks

Trademarks are a word, slogan, image, or other device identifying the goods or services of a particular party. Trademark infringement occurs when one party utilizes the mark in such a way as to create confusion, mistake and/or deception with consumers. The confusion can indicate the defendant's products or services are the same as the trademark owner’s or that the defendant is somehow associated with or sponsored by the trademark owner. If either is not true or one does not have permission to use the trademark, it should be avoided.
